About the Department
Invest India is the National Investment Promotion and Facilitation Agency under the Department for Promotion of Industry & Internal Trade (DPIIT), Ministry of Commerce and Industry, Government of India. It hosts teams working with various government initiatives such as Make in India, Startup India, AGNIi, and PMG.
Invest India is looking to hire an experienced Legal Counsel with a strong understanding of regulatory and legal framework of India.
Key Responsibilities
- To provide professional legal advice and guidance on a wide range of legal matters, including corporate law, commercial contracts, regulatory compliance, intellectual property, data protection, employment law, and dispute resolution across multiple jurisdictions, legal leadership, strategy, and risk management through knowledge experience and help develop compliance systems and processes for Invest India.
- Advising on aspects of FDI and Trade. This includes assisting relevant business lines with performing due diligence and drafting.
- To provide and set strategic direction, oversee various legal regulatory and government affairs related matters and be accountable for compliance in all areas of laws and have preventive measures in place.
- To conceptualize, develop and implement highly efficient systems to formulate general management policy and internal governance policies to monitor compliance regularly.
- To ensure legality of all significant contracts entered in particular regarding third party contractors, distributors, vendors, suppliers, purchasing, employment, compensation etc.
- To advise on employment related issues, e.g. termination, severance, mutual separation, outsourcing arrangements, employment templates.
- To participate, assist and liaise with government and corporate functional departments on key technical service fee agreements, professional consultancy/services agreements, licensing and assignments as well as in dealing with third parties in matters of conflict and settlement.
- To be actively involved and work with external counsel in managing potential litigation and ensure that Invest India’s interest is protected.
- To develop and maintain relationships with relevant external contacts and organisations (e.g. external lawyers, lawyers of key customers/competitors, governmental organisations, regulators, trade/industry associations, external bodies, etc.) and identify work to be outsourced, select and manage external lawyers, their fee arrangements and service levels, and to instruct, manage and liaise with external lawyers as per requirement.
- To develop and have training programs for non-legal functions on contracts, intellectual property, confidentiality, marketing law issues, etc., where necessary.
- To conduct legal research, monitor local legal developments in countries of operation, and assess their impact on the organization and its operations, proactively identify legal risks and provide recommendations for due compliance.
- Working closely with key functions and various stakeholders in teams such business development, procurement, IT and HR.
Qualifications
- LL.B/LL.M from a university recognized in India.
- At least 15-20 years' experience in the practice of law, a combination of law firm and in-house counsel experience preferred.
- History of effectively supporting a demanding client base, serving as counsellor on ground-breaking, emerging legal issues in a complex, fast-paced and evolving legal and policy environment.
- Possess exceptional written and verbal communication skills to effectively communicate complex legal concepts to both legal and non-legal stakeholders. Collaborate effectively with cross-functional teams and external partners in diverse cultural settings.
- Strong and wide compliance/commercial experience. Prior government experience will be a plus, but not necessary.
- Highest ethical standards, promote ethical behaviour and high professional integrity.
- Excellent interpersonal, organizational and analytical skills.
- Ability to think strategically, take strategic risks and make tough decisions.
